The media monitoring services provided by Commercial Monitors are designed to provide media information and analysis to subscribers by delivering data generated by our company and media content as reference to the data. Unless otherwise stated, Commercial Monitors reserves all copyright in the content and design of the website and the information contained in the website and services. Commercial Monitors holds all copyright in Commercial Monitors Service Materials (Service Materials) including reports, summaries and analysis provided as part of the service.
By accessing our service, a registered user acknowledges and agrees that:
Advertising Content - Other than service material which is created by Commercial Monitors, except where expressed in writing by Commercial Monitors or the copyright owner, they will not edit, disseminate, reproduce, redistribute, retransmit, re-broadcast, transfer, publicly view, resell or commercially exploit any advertising content in the service.
- Advertising content includes audio dubs, video dubs, verbatim transcripts, print clippings, photographs, banner ads or PDF clippings in hardcopy or digital format are for internal research and reference and are solely provided as reference to issued reports, summaries or analysis by Commercial Monitors provided as part of the service material.
- Commercial Monitors may remove advertising content independently sourced from the media, including publications, broadcasts, and online websites or provided by advertisers, advertising agencies, media agencies or third parties from Commercial Monitors service material that infringes the copyright or other intellectual property rights of others. If you believe that your copyright has been infringed, please notify Commercial Monitors through our contact details.
News and Editorial Content - Other than service material which is created by Commercial Monitors, news and editorial content (the Report) is owned by a radio or television broadcaster that was originally broadcast by that owner, and they will not edit, disseminate, reproduce, redistribute, retransmit, re-broadcast, publicly view, resell or commercially exploit the Report unless Commercial Monitors or the registered user has first obtained written permission from the copyright owner.
- A Report includes verbatim transcripts, audio dubs, video dubs in hardcopy or digital format. A Report is supplied for internal research and reference of the registered user and is provided under Australian Association of Information Monitors (AAIM) Licence as reference to issued reports, summaries or analysis by Commercial Monitors provided as part of the service material.
- AAIM Copyright Fees for Commercial Monitors reproduction of the Report from a television or radio broadcast will be payable by a registered user for use and acquisition of the Report, and the registered user acknowledges and agrees to pay all AAIM Copyright Fees to Commercial Monitors which may be increased from time to time by notice in writing.
- The registered user acknowledges and agrees that the Report:
• is for the use of registered user only; • shall contain only that information in which a subscriber has an interest and shall not knowingly include a program presented for entertainment • must not be copied or passed on to a third party for financial or other benefit, and • may be subject to error or omission.
If the registered user or the organisation of the registered user of the Service Materials is from Government or a Government Agency, they may wish to rely on Section 183 of the Copyright Act which gives it a statutory right to carry out or to authorize the monitoring of broadcasts. In such cases, the registered user is exempt from AAiM License Fees. It is essential that the organization of the registered user provide Commercial Monitors formal authorization under Section 183 of the Copyright Act to monitor and to make the recordings, acknowledging that it (the Government or Government Agency) is liable for copyright payment.
